The emergence of Andy Uba as the All Progressives Congress candidate in the Anambra governorship election was declared illegal by a Court that nullified the Primary election of the party that produced him.

 

This was the declaration of Justice Inyang Ekwo of a Federal High Court in Abuja on Monday, who ruled that the participation by Uba in the November 6 election was void.

 

The judge ruled that the plaintiff, Mr George Moghalu, who was a contestant for APC’s candidacy, had proved that the ruling APC did not conduct a valid primary election from which Uba could have emerged.

 

Ruling on this, Justice Ekwo declared that Uba could not have been a candidate in the poll, since his victory came from an illegal primary election.

 

Justice Ekwo, therefore,  ordered the Independent National Electoral Commission to remove Uba from its record as a candidate in the election. It also ordered the APC to refund to Moghalu the sum of N22.5m which he paid for expression of interest and nomination forms since the party failed to conduct a valid primary.
