The Nigerian Supreme Court, Friday, ruled as unlawful and unconstitutional the Executitve Order 10(EO10) issued by President Buhari on the funding of state Judiciary and Legislature.
The Executive Order 10 which was signed into law on May 22,20202, gave financial autonomy to the legislature and judiciary in the 36 states of the Federation.
The order empowered the accountant -General of the federation to deduct funds for the state legislature and judiciary from the federation allocation to the states, and took control of funding from the state governors.
The Supreme Court in a split decision of of six out seven ruled that President Buhari exceeded his constitutional power in issuing the EO10.
However, the seven judges were unanimous in their decision that the states were not entitled to refund of N66bn they had spent to maintain the courts since 2020.
