The Nigerian Communications Commission (NCC) has asked the Federal High Court in Lagos not to honour the suit filed by MTN Nigeria Communications Limited, challenging the 1.04 trillion Naira fine slammed on it by the commission.
NCC made the call on Wednesday in a motion on notice, praying the court to dismiss MTN’s suit for lack of jurisdiction or send it to the Abuja division of the court.
NCC further argued that the suit was filed in error in Lagos. The commission noted that the subject of dispute took place in Abuja, while the two respondents in the suit, the NCC and the Attorney General of the Federation are also based in Abuja.

In the suit which is still pending hearing, MTN held that it was not given a fair hearing by NCC and that it was not given enough time to comply with the NCC directive whose violation led to the sanction.
