An attempt by the National Drug Law Enforcement Agency (NDLEA) to secure the extradition of Senator Buruji Kashamu suffered another blow on Wednesday when a Federal High Court sitting Abuja dismissed the Federal Government’s application for the extradition of the Senator over drug-related offences.

The suit was filed by the immediate past Attorney-General and Minister of Justice, Mohammed Adoke, a day before the expiration of the tenure of Goodluck Jonathan.

Kashamu currently represents Ogun-East Senatorial District at the National Assembly.

There had been a battle to extradite him to the United States of America to face trial for the alleged drug related crime.

Kashamu recently suffered a house arrest that lasted for many days before he was rescued by an order of the court.

On Wednesday, when the case came up, Justice Gabriel Kolawole said he lacked jurisdiction to entertain the suit.

He hinged his ruling on the argument that the judgment of a division of the same court in Lagos presided over by Justice Okon Abang, nullifying the proceedings on June 8, 2015 and the same judgment affirmed by another judge of the same Lagos division had not been set aside by an appellate court.

Abang’s ruling nullifying the proceedings was affirmed by Justice Ibrahim Buba on 23rd June 2015.

Kolawole said with the current status of the case, only the Court of Appeal could determine whether the earlier judgements were right or wrong.
