Following the favourable ruling he got from court on Thursday, the suspended Governor of the Central Bank of Nigeria (CBN), Malam Sanusi Lamido, has filled a fresh suit seeking to halt investigation into his tenure by the Financial Reporting Council of Nigeria (FRCN).

Sanusi filled the application through his counsel, Mr Kola Awodehin (SAN) on Friday.

On behalf of Sanusi, Awodehin, prayed the court to declare it as beyond FRCN’s power to constitute itself into an investigating body as it claimed in some newspaper publications of 24th March. Joining FRCN and Executive Secretary of the FRCN as the first and second defendants, Sanusi urged the court to declare that the proposed investigation as advertised in Punch Newspaper of March 24 was tantamount to a breach of natural justice.

Sanusi argued that since the FRCN has already reached a conclusion about his guiltiness on the matter, the body can no longer carry on investigation in the same matter impartially. He therefore, sought an order restraining the defendants or any person, body, agent, or privies, under its authority, or pursuant to the FRCN Act, from conducting and continuing with investigation or inquiry as advertised.

In response, FRCN and the second defendant filled a preliminary file in objection claiming that it is out of the Federal High Court’s jurisdiction to rule in the matter.

 Justice James Tsoho however, ruled that he would hear the defendant’s objection and the plaintiff’s motion together. He ordered that everything should remain as it currently is until the suit is finally determined.
